The short version: Using beanspill means you agree to these terms. Dictation is free and runs entirely on your device. The optional Pro upgrade (on-device AI cleanup) is a one-time purchase billed by our payment provider. The software is provided "as is", AI output can be imperfect, and you're responsible for how you use what it produces.
These Terms of Service ("Terms") are an agreement between you and the makers of beanspill ("beanspill", "we", "us") covering the beanspill desktop app (macOS and Windows) and the website beanspill.app (together, the "Service"). By downloading, installing, or using the Service you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service. You must be at least 16 and able to form a binding contract.
beanspill has these parts:
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for personal or internal business use. You may not resell, redistribute, rent, or sublicense the app or a licence key; reverse-engineer, decompile, or circumvent the Pro licensing or our servers; use the Service to build a competing product; or remove or alter any notices.
You agree not to use the Service to break the law, infringe others' rights, or generate or distribute unlawful, harmful, or abusive content; to attack, overload, probe, or disrupt our servers or the AI Assistant (including exceeding or evading rate and usage limits); to share, pool, or resell access to the Assistant; or to submit content you don't have the right to submit. We may suspend or terminate access for conduct that breaches this section.
Pro requires a valid licence key tied to your purchase. Keep it confidential — you're responsible for activity under your key. A key may be activated on your own devices; sharing it publicly or across unrelated users is not permitted and may result in suspension. We may validate your key with our payment provider.
Pro is sold as a one-time purchase (currently $39.99; the displayed price and currency may vary by region). Payments and checkout are handled by Polar (polar.sh), acting as our Merchant of Record and reseller. Your purchase is also subject to Polar's terms, and Polar processes your payment details under its own privacy policy — we never see or store your full card information.
Refunds are handled as described in our Refund Policy. Statutory rights that apply to you (for example, EU/UK consumer rights) are not affected by these Terms.
The Service relies on third parties that have their own terms: Polar for payments, and — if and when the AI Assistant launches — Anthropic (the Claude API) to power it. We aren't responsible for third-party services, but we choose them to handle your data responsibly. The free on-device dictation and the Pro on-device cleanup do not depend on any of them.
beanspill, its software, branding, and content are owned by us or our licensors and protected by law. As between you and us, you keep all rights to the text you dictate and the requests you send to the Assistant. You grant us only the limited, temporary right to process that content to provide the Assistant's response for that request. We do not use your dictation, requests, or screenshots to train models.
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Speech recognition and AI-generated answers can be inaccurate or incomplete — review output before relying on it. The Assistant does not provide professional (legal, medical, financial, or other) advice. We don't warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, beanspill will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or USD $50. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.
You may stop using the Service at any time. We may suspend or terminate your access (in whole or in part) if you breach these Terms, abuse the Service, or fail to pay, or where required by law. On termination, the licence in Section 3 ends; sections that by their nature should survive (e.g., 9–11) continue.
We're actively developing beanspill and may add, change, or remove features. We may update these Terms; we'll revise the date above and, for material changes, take reasonable steps to let you know. Continuing to use the Service after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts of England and Wales. This does not deprive you of any protection given to you by mandatory consumer-protection law in your country of residence — if you are a UK or EU consumer, the rights you have at home still apply and you may be able to bring proceedings locally.
